Terms of Use
These Terms of Use ("ToU") govern your access to and use of the StagingPulse platform and services (the "Service"). By accessing or using the Service, you agree to be bound by these ToU.
1. Acceptance of Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these ToU. If you do not agree to these terms, you may not access or use the Service.
2. Service Description
StagingPulse provides AI-powered real estate photo enhancement services, including but not limited to virtual staging, sky replacement, room cleaning, and wall color modification.
3. Account Termination
We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason, including, but not limited to, non-payment, breach of these ToU, or engaging in fraudulent or abusive activities.
4. Subscriptions, Payments, and Refunds
a. Subscription Model: Access to the Service is provided via monthly or annual subscription plans (collectively, "Subscriptions"). By purchasing a Subscription, you agree to pay the fees at the rates applicable at the time of purchase.
b. Automatic Renewal: Subscriptions are billed in advance on a recurring, periodic basis (monthly or annual). Your Subscription will automatically renew under the exact same conditions unless you cancel it or We cancel it.
c. Cancellation: You may cancel your Subscription at any time. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the Service until that date.
d. Money-Back Guarantee: We offer a 14-day money-back guarantee starting from the date of the initial Subscription purchase. If you are dissatisfied with the Service, you may request a full refund within this 14-day period. This guarantee is valid only for the initial purchase of a Subscription and does not apply to renewals or subsequent purchases.
e. Price Changes: We reserve the right to change the fees for the Service at any time. Any price changes will take effect at the beginning of the next subscription period following notice to you.
5. Intellectual Property Rights
a. User Ownership of Generated Images
Notwithstanding anything to the contrary in these ToU, the User who has paid for the Service shall retain all ownership rights to the images and content generated through the Service (the "Generated Images").
b. License to Generated Images
We grant the User a worldwide, non-exclusive, perpetual, irrevocable, fully paid, and royalty-free license to use, reproduce, modify, adapt, publish, and display the Generated Images for any commercial purpose, including, but not limited to, real estate listings, marketing, and advertising.
c. Our Property
All elements of the Service (software, algorithms, trademarks, and the underlying AI model) remain the exclusive property of StagingPulse. You are strictly prohibited from copying, decompiling, or reverse-engineering the Service's underlying technology.
6. Acceptable Use Policy
The User agrees not to use the Service to upload, generate, or process content that is:
a. Illegal or Harmful: Content that is unlawful, fraudulent, defamatory, discriminatory, or harmful to minors.
b. Hate Speech or Violence: Content promoting hate speech, violence, or illegal acts.
c. Intellectual Property Infringement: Content protected by copyright, trademark, or other proprietary rights, unless you have the necessary licenses or permissions.
d. Nudity or Sexual Content: Pornography, sexually explicit materials, or non-consensual graphic content.
e. Unauthorized Personal Data: Images or data of identifiable individuals without their explicit consent.
f. Misuse of AI: Attempting to disrupt the integrity or performance of the Service, or training other AI models using the output data from StagingPulse.
We reserve the right, but not the obligation, to monitor, review, and remove any content that, in our sole judgment, violates these ToU.
7. Disclaimers and Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be available uninterrupted, error-free, or completely secure.
In no event shall StagingPulse, or its representatives, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service.
8. Governing Law and Dispute Resolution
These ToU shall be governed by and construed in accordance with the laws of France. Any dispute arising out of or relating to these ToU shall be submitted to the exclusive jurisdiction of the courts located in Dijon, France.
